Abortion laws in India

How they are changing and what is the effect of it culturally, socially, emotionally, mentally, and overall. From the Indian perspective, abortion is allowed if the continuance of the pregnancy would involve a risk to the life of the pregnant woman or grave injury to her physical or mental health. The Medical Termination of Pregnancy Bill first came into effect in the year 1971 and came off the Statute Book as the “The MTP Act. 1971”. As per the said Act, abortions can only be carried out till 20 weeks of conception. This rule was placed in order to prevent sex-selective abortions, which then could only be done post the 20-week mark. However, with the advancement of technology, the sex of the baby can be determined as early as seven weeks of pregnancy through a new blood test. Also, it can be predicted through chorionic villus sampling (CVS) around the 10th to 12th week and between 15 to 20 weeks by amniocentesis. Post the 20-week bar The MTP Act 1971 allows abortions till 20 weeks of pregnancy, however, there are situations where fetal abnormalities or risks to a mother’s life come to light after 20 weeks of pregnancy. In such cases, the Act requires approval from the court and there have been cases where the court gave negative judgment despite the family wanting the abortion. Additionally, there are cases involving underage rape victims and child assault where the pregnancy may come to light quite late only when the child develops symptoms. The act didn’t take into account that the 20-week ceiling may be close or well past and such cases are more rampant than a rarity. Amendment to MTP Act 1971 The MTP Act 1971 recently underwent an amendment and the new act places India in the top league of countries serving women who wish to make individual choices from their perspectives. It allows women to seek abortions as part of reproductive rights and gender justice. With the upper limit of MTP raised from 20 to 24 weeks for women including rape survivors, victims of incest, differently-abled women, and minors, the new law is now forward looking, empathetic, and looks at a sensitive issue with a human face. Additionally, it acknowledges the failure of contraception and allows medical termination of pregnancy to “any woman or her partner” replacing the old provision for “only married woman or her husband”. The bill will protect the dignity and rights of women and empower them especially those who are vulnerable and victims of rape. Another important feature of the amendment includes, opinion of only one provider will be required up to 20 weeks of gestation and of two providers for termination of pregnancy of 20-24 weeks of gestation. The cultural and societal aspect The recent bill is a step in the right direction towards the safety and well-being of women and many women are sure to be benefited from this. It aims to provide greater rights to women as abortion is considered an important aspect of the reproductive health of women. The proposed increase in gestational age will ensure that women in need of terminating pregnancy get the desired autonomy, dignity, confidentiality, and justice in doing so. More so, raising the upper limit of abortion to 24 weeks in special categories will empower women by preserving and protecting their dignity. As a country, we need to stand strong in the world of cultural competence by making it easier for our women to safely and legally terminate an unwanted pregnancy. Some general signs and symptoms associated with, but not specific to, cancer, include: Fatigue Lump or area of thickening that can be felt under the skin Changes in weight – unintended loss or gain Changes in skin including yellowing, darkening or redness of the skin, or changes to existing moles Changes noticed in bowel or bladder habits Long existing cough or breathing troubles Difficulty in swallowing Hoarseness Regular indigestion or discomfort after eating Consistent unexplained muscle or joint pain Regular unexplained fevers or night sweats Bleeding or bruising without any reason   Causes   Cancer is the result of a normal body cell that may end up growing abnormally. Many things may cause abnormalities in cell and have been linked to cancer development. While the causes of some cancers remain unknown, other cancers have environmental or lifestyle triggers or may develop from more than one known cause. Some other cancers may be influenced by a person’s genetic makeup. A combination of these factors may be responsible for the development of cancer in many patients. Although it is often difficult or impossible to figure out the exact cause of cancer in a specific person, research has provided clinicians with a number of likely causes that alone or with other causes may be responsible for initiating cancer. The following are some of the major causes, however, it is not all-inclusive as specific causes are Exposure to chemical or toxic compound: Benzene, asbestos, or cigarette smoke (contains at least 66 known potential carcinogenic chemicals and toxins), and aflatoxin etc. Ionizing radiation: Uranium, radon, ultraviolet rays from sunlight, radiation from alpha, beta, gamma, and X-ray-emitting sources. Pathogens: Human papillomavirus (HPV), Epstein-Barr virus (EBV), hepatitis viruses B and C to name a few as other bacteria are being researched as possible agents. Genetics: A number of specific cancers have been linked to human genes which include breast, ovarian, colorectal, prostate, skin, and melanoma.  Emotional state and cancer At any stage, after you are diagnosed with cancer, you may experience a wide range of emotions such as disbelief, fear, sadness, anxiety and anger. These feelings can be categorized as type of grief – cancer often involves multiple losses, such as the loss of good health, changes to your appearance, disruption of your normal activities, changed financial plans, a loss of independence, changed relationships, and a shift in the way you see yourself. It takes time and great deal of effort to adjust to these changes. The word cancer turns your world upside down and can bring up a wide range of feelings you’re not used to dealing with. In addition, it can make existing feelings seem more intense and your response to it may change daily, hourly or even minute to minute. Girl Child – A blessing A girl child has been a subject of discrimination in India since ages, even today, girls are treated as a burden and are given less importance when compared to boys with several restrictions and less opportunities to grow in life. Moreover, it is a matter of great shame that female infanticide is still prevalent and among all countries, India stood at 192nd rank in 2018 with a dismal sex ratio of 106.98, which means there were only 93.47 females for every 100 males. Furthermore, according to an article, about 400,000 sex-selective abortions have taken place annually in India in recent years! Global scenario While gender inequality or gender discrimination is seen at a higher rate in India, the phenomenon is prevalent in many other countries as well. Women in many other countries are fighting for the right to vote, to wear clothes of their choice, to drive a car among other small things for themselves. Female Genital Mutilation (FGM) and trafficking are some of the horrific practices highly prevalent in certain parts of Africa, Latin America, Asia, and eastern Europe. Children, adolescents, and youth are becoming victims of drug addiction and they are struggling to cope with this social menace. Peer pressure, adolescent immaturity and irresponsible parenting are the three-headed monsters luring children and adolescents towards addiction and a life of suffering and regret. There is an urgent need to scale up prevention, early intervention, and harm reduction of drug substances.  Drug addiction leads to chronic brain and other diseases. As a social evil drugs have the potential to cripple the younger generation enormously. What is Drug Addiction? It is simply referred to as a condition in which a person is addicted to any kind of drug. A strong and uncontrolled impulse to consume drugs is found in most cases. It usually begins with peer pressure for fun or due to curiosity but repeated consumption takes the form of abuse or addiction.  Types of Drugs A Report – “Magnitude of Substance Use in India” by the National Drug Dependence Treatment Centre (NDDTC) of the All India Institute of Medical Sciences (AIIMS) has assessed the magnitude of use of Alcohol, Cannabis (Bhang and Ganja/Charas), Opioids (Opium, Heroin and Pharmaceutical Opioids), Cocaine, Amphetamine Type Stimulants (ATS), Sedatives, Inhalants, and Hallucinogens. These are the main types of drugs consumed in the country. Cocaine and amphetamines are stimulant drugs and can have a significant impact on the release of excitatory neurotransmitters. Alcohol and heroin are depressant drugs. They work by activating the inhibitory neurotransmitters. Both mood and personality are affected by these drugs. There is some drug known as hallucinogenic and LSD and magic mushrooms fall in this category. These drugs adversely affect the nervous system- especially that control perception and thought process. According to the NDDTC Report, the most common drugs detected from urine samples at laboratories are Cocaine, Amphetamine, Methamphetamine, Methadone, Morphine/Opiates, Phencyclidine (Angel dust/Hog/Killer Weed), Barbiturates, Benzodiazepines and Cannabinoids (THC/Marijuana).  Effects  These drugs can be habit-forming. Drug consumption can cause dizziness, drowsiness, respiratory depression and permanent or temporary damage to the central nervous system. Drug addiction affects both individuals and society. It is proven that drugs can damage the ability to think rationally and addicts ignore all responsibility towards career, family, friends, and even themselves. Usually, it starts on an experimental basis and after some time becomes a compulsion leading to addiction.  Adverse effects of drugs include health problems- liver, heart, blood sugar, hypertension, high cholesterol, memory disorders, imbalance, anxiety, depression, sleep disorder, weight loss or gain, decreased immunity, infertility- and psychological/Behavioural changes.
